Regulation 44 Inspections:

A significant speciality of ours; we have vast experience of providing monthly Independent Regulation 44 Inspections for residential children’s homes and pride ourselves on providing not just a compulsory service, but a truthful, useful and pro active inspection.


Our regulation 44 Inspections are completely independent; we do not ever work in ‘quality assurance’ roles and are never directly employed through any organisation to ensure our independence.

As required in The Children’s Homes Regulations 2015 we assess the quality of care provided and your safeguarding arrangements but also assess the home holistically; this ensures a quality and useful service for providers.

We always try to discuss the children’s home with external stakeholders, the staff and children themselves (where appropriate) for example.

Our experience within the industry allows us to understand the role of a Responsible Individual, Registered Manager and every level of staffing (we have been there).

Our experience of other Residential Children’s Homes allows us to identify good practice and then importantly, share this with you and provide realistic advice and strategies for improvement.


Our experience of working with Ofsted and analysing their inspections of our past and present clients allows us to identify trends and share these with you.

What is a Regulation 44 Inspection?

A Regulation 44 Inspector, otherwise known as an ‘Independent Visitor’ is required to visit and inspect Residential Children’s Homes a minimum of once per month to assess the safeguarding arrangements and quality of care provided.

The Regulation is as follows:

Independent person: visits and reports
44.—(1) The registered person must ensure that an independent person visits the children’s home at least once each month.

(2) When the independent person is carrying out a visit, the registered person must help the independent person—

  1. (a)  if they consent, to interview in private such of the children, their parents, relatives and persons working at the home as the independent person requires; and
  2. (b)  to inspect the premises of the home and such of the home’s records (except for a child’s case records, unless the child and the child’ s placing authority consent) as the independent person requires.

(3) A visit by the independent person to the home may be unannounced.

(4) The independent person must produce a report about a visit (“the independent person’s report”) which sets out, in particular, the independent person’s opinion as to whether—

  1. (a)  children are effectively safeguarded; and
  2. (b)  the conduct of the home promotes children’s well-being.

(5) The independent person’s report may recommend actions that the registered person may take in relation to the home and timescales within which the registered person must consider whether or not to take those actions.

(6) If the independent person becomes aware of a potential conflict of interest (whether under regulation 43(3) or otherwise) after a visit to the home, the independent person must include in the independent person’s report—

  1. (a)  details of the conflict of interest; and
  2. (b)  the reasons why the independent person did not notify the registered provider of the conflict of interest before the visit.

(7) The independent person must provide a copy of the independent person’s report to—

  1. (a)  HMCI;
  2. (b)  upon request, the local authority for the area in which the home is located;
  3. (c)  the placing authorities of children;
  4. (d)  the registered provider and, if applicable, the registered manager; and
  5. (e)  the responsible individual (if one is nominated).
  1. (a)  children are effectively safeguarded; and
  2. (b)  the conduct of the home promotes children’s well-being.

(5) The independent person’s report may recommend actions that the registered person may take in relation to the home and timescales within which the registered person must consider whether or not to take those actions.

(6) If the independent person becomes aware of a potential conflict of interest (whether under regulation 43(3) or otherwise) after a visit to the home, the independent person must include in the independent person’s report—
